1. General Information

We, ENPULSION GmbH (we or ENPULSION), process personal data in accordance with the relevant data protection laws, in particular the General Data Protection Regulation (GDPR).

This Privacy Policy applies to you as an individual (including your employees, advisors, contractors, and other associated persons) who uses our online services (our website and its associated sites, features, and content; collectively, the Online Offering), or who enters into, or intends to enter into, a contractual relationship with us (you).

This Privacy Policy informs you about the nature, scope, and purpose of the processing of personal data through our Online Offering and in the course of concluding and fulfilling contracts outside the Online Offering.

To ensure compliance with data protection regulations, we implement organizational, legal, and technical security measures according to the state of the art (e.g., encrypted data transfer between your browser and our server). This also applies when we use subcontractors to provide our services.

Specifically, as a contractual partner of ENPULSION, you consent to the processing of your personal data in connection with the conclusion and fulfillment of contracts between you and ENPULSION.

2. Basic Information on Data Processing and Legal Basis

The data protection terms used in this Privacy Policy (e.g., "personal data" or "processing") follow the definitions in Art. 4 GDPR.

Personal data we may process, as provided or collected during your use of the Online Offering, includes: name, address, contact details (phone number, email), services used, contact person names, payment information, data on accessed webpages, and entries made in contact or online order forms.

Data is processed on one or more of the following legal bases:

  • Your consent to data processing (Art. 6 para. 1 lit. a GDPR);
  • Necessity for fulfilling a contract with you (Art. 6 para. 1 lit. b GDPR);
  • Compliance with legal obligations (Art. 6 para. 1 lit. c GDPR);
  • Protection of our legitimate interests or those of third parties (e.g., prevention of data misuse, legal enforcement).

Data is deleted when it is no longer required for its processing purpose and legal retention obligations do not prevent deletion. If data is needed for asserting legal claims within the statutory limitation period, it will be retained accordingly. Applicant data is deleted after 12 months.

3. Disclosure of Data to Third Parties and Third Countries

If content, tools, or services from other providers (third-party providers) are used and they are located in a third country, data may be transferred to their home countries. Third countries are generally those outside the EU/EEA.

You acknowledge and agree that we may transmit your personal data to:

  • ENPULSION Inc, 55 River Oaks Pl #702, San Jose, CA 95134, USA
  • Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA
  • Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (or Facebook Ireland Ltd. for EU residents)
  • Google Tag Manager: Use Policy
  • Zoho Corp, 4141 Hacienda Drive, Pleasanton, CA 94588, USA

4. Use of the Online Offering

If using our Online Offering involves fulfilling or initiating a contract, we process personal and contractual data (such as IP address and usage timestamps) under Art. 6 para. 1 lit. b GDPR.

Disclosure to third parties generally does not occur unless you consent or a legal basis applies (see Section 2.3).

5. Contacting Us

When you contact us, the data you provide or transmit will be used to process your request. If your inquiry does not lead to a contract, the data will be deleted after 12 months.

6. Access Data and Log Files

To prevent and investigate misuse or fraud, we store data on server access (server log files), including: webpage name, file, date/time of access, data volume, access status, browser version, OS, referrer URL, IP address, and provider.

These are stored for up to 30 days for security reasons and then deleted, unless required for evidence purposes.

7. Cookies

Cookies are data saved to your browser from our or third-party servers.

We use session cookies essential to provide our services (e.g., login status, shopping cart functionality). These do not require consent and are deleted when you close your browser.

Cookies for analytics or advertising (see Section 9) may also be used. You can disable them in your browser, though this may affect functionality.

8. Integration of Third-Party Content

We use third-party content (e.g., videos, fonts) to improve our Online Offering. This requires transmitting your IP address to those providers.

We aim to minimize data processing by choosing providers who only collect IP addresses as needed.

Some providers also use web beacons for statistics/marketing (tiny graphic files). Data collected may include technical browser/OS data, referring sites, visit times, and usage patterns. This data may be stored in cookies and linked with other sources.

Examples:

9. Google Analytics

We use Google Analytics to analyze and improve our Online Offering. Data is typically sent to Google servers in the USA. Google is certified under the Privacy Shield.

We use IP anonymization: IP addresses are shortened within the EU/EEA.

You can prevent Google Analytics tracking by adjusting your browser settings or installing this plugin:

10. Facebook Social Plugins

We use Facebook plugins (e.g., Like buttons) based on our legitimate interests.

Clicking a plugin connects your device directly to Facebook servers. If you are logged in, Facebook can link your visit to your account. If you’re not a member, your IP may still be stored.

11. Facebook Marketing Services

We use the Facebook Pixel to target visitors of our Online Offering with ads (Facebook Ads).

The pixel can set a cookie on your device. When logged into Facebook, your visit may be linked to your profile. This data is anonymized for us but stored and processed by Facebook.

Data transmitted to Facebook is encrypted locally in your browser before being sent via a secure connection.
